1. Agreement to Terms

The Bunyar Contracting LLC SMS Program allows you to receive text messages (SMS/MMS) containing:

3. Eligibility
To participate in the Program, you must:
Be at least 18 years of age or the age of majority in your jurisdiction
Be a resident of the United States
Have a mobile phone capable of receiving text messages
Provide a valid U.S. mobile phone number
Have authorization to provide the mobile phone number for enrollment
You may not enroll a phone number that you do not own or have authorization to use.
4. Opt-In and Consent
Enrollment:
By providing your mobile phone number and checking the consent box(es) on our opt-in form, you:

Authorize us to send marketing and/or transactional messages to your mobile number
Acknowledge that you have read and agree to these Terms and our Privacy Policy
Confirm that the mobile number provided is your own
Consent Not Required for Purchase:
You are not required to opt in to the Program or consent to receive text messages as a condition of purchasing any goods or services from Bunyar Contracting LLC.

5. Message Frequency
Message frequency varies and depends on:

Estimated Frequency: You may receive approximately 2-8 messages per month. Message frequency may increase during peak promotional periods or decrease during slower periods.
We reserve the right to modify message frequency based on business needs, promotional activities, and Program requirements.
6. Message and Data Rates
Standard message and data rates may apply to each text message sent or received in connection with the Program, as determined by your mobile carrier. These charges will appear on your mobile phone bill or be deducted from your prepaid balance.
You are responsible for all message and data charges incurred. Please contact your mobile carrier for information about your messaging plan and applicable rates.
Bunyar Contracting LLC is not responsible for any charges incurred from your mobile carrier.
7. How to Opt-Out (Unsubscribe)
You may opt out of the Program and stop receiving text messages at any time using any of the following methods:

9. Supported Carriers
The Program is supported by major U.S. mobile carriers, including but not limited to:
AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, Google Voice, and other carriers.
Carrier Limitations:
Not all carriers support all message features (such as MMS)
Message delivery may vary by carrier and location
Some carriers may block or filter messages
We are not responsible for carrier-related delivery issues
Check with your mobile carrier for compatibility and service availability.
10. User Responsibilities
By participating in the Program, you agree to:
Provide accurate and current contact information
Update your information if your mobile number changes
Notify us immediately if you no longer have access to the enrolled phone number
Use the Program only for lawful purposes
Not interfere with or disrupt the Program
Not attempt to gain unauthorized access to our systems
Comply with all applicable laws and regulations
Be responsible for all activity on your enrolled phone number
11. Prohibited Uses
You may not:
Enroll a phone number you do not own or have authorization to use
Use the Program to harass, abuse, or harm others
Send spam or unsolicited messages through the Program
Attempt to reverse engineer or compromise Program security
Use automated systems or bots to interact with the Program
Violate any applicable laws, including the TCPA
Misrepresent your identity or affiliation
Violation of these prohibitions may result in immediate termination from the Program and potential legal action.
12. Program Modifications and Termination
Our Rights:
We reserve the right, at our sole discretion, to:
Modify, suspend, or terminate the Program at any time
Change message frequency, content, or features
Update these Terms with or without notice
Remove participants who violate these Terms
Discontinue service to any phone number or carrier
Notification:
We will make reasonable efforts to notify you of material changes to the Program or these Terms, but we are not obligated to do so.
No Liability:
We are not liable for any modification, suspension, or termination of the Program.
13. Disclaimer of Warranties
THE PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability or fitness for a particular purpose

That messages will be delivered on time or at all
That the Program will be available at all times
That the Program will be free from errors, viruses, or security vulnerabilities
That messages will be compatible with all devices or carriers
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
No Liability for Damages:
Bunyar Contracting LLC, its owners, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:
Your participation in the Program
Delayed, failed, or misdirected messages
Unauthorized access to your information
Errors or interruptions in the Program
Message and data charges from your carrier
Loss of data or information
Any other Program-related issues
Maximum Liability:
Our total liability to you for all claims related to the Program shall not exceed $100 or the amount you paid to us in the past 12 months, whichever is less.
Exceptions:
Some jurisdictions do not allow limitations on implied warranties or liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Bunyar Contracting LLC, its owners, officers, employees, agents, contractors, and service providers from and against any and all claims, damages, losses, costs, expenses, and liabilities (including reasonable attorneys' fees) arising from or related to:

Your violation of any applicable laws or regulations

Your violation of any third-party rights

19. Severability

20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bunyar Contracting LLC regarding the Program and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
21. Waiver

24. Changes to These Terms
